WAIVER
I HAVE READ THE ENTIRE DOCUMENT, UNDERSTOOD IT, AND AGREE TO BE BOUND BY ITS TERMS.
GENERAL WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT By clicking “Join,” signing up, registering, or otherwise participating in any event organized by 10AMHI.COM, Darren Mayer and/or affiliated or co-hosting events (collectively, the “Event Organizers”), I, the participant, acknowledge and agree to the following terms:
1. Acknowledgment of Risks
I acknowledge that participation in athletic events, including street races held in public or semi-public spaces, involves inherent risks including, but not limited to: physical exertion, collisions with people or objects, falls, road hazards, vehicular traffic, weather conditions, negligent acts of other participants, and equipment failure. These risks may result in serious personal injury, permanent disability, death, or property damage. I voluntarily and knowingly assume full responsibility for all such risks, whether foreseen or unforeseen, even if caused in whole or in part by the negligence of the Event Organizers or other participants.
2. Release of Liability
In consideration of being permitted to participate in any way in events hosted, sponsored, or facilitated by the Event Organizers, I, for myself, my heirs, executors, administrators, legal representatives, and assigns, do hereby release, waive, discharge, and hold harmless 10AMHI.COM, Darren Mayer, any co-organizers, sponsors, venue owners, property owners, municipal agencies, and each of their respective officers, directors, employees, volunteers, agents, and representatives (collectively, the “Released Parties”), from any and all claims, demands, liabilities, causes of action, damages, costs, or expenses (including legal fees), arising out of or in any way connected with my participation in any event, whether caused by negligence or otherwise.
3. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, suits, damages, losses, liabilities, and expenses (including attorneys’ fees and costs) arising out of or resulting from (a) my participation in any event; (b) my breach of this Agreement; or (c) any act or omission by me that causes harm or damage to any person or property.
4. Medical Treatment Consent
I authorize the Event Organizers to secure emergency medical treatment for me if deemed necessary. I understand and agree that I am solely responsible for any costs associated with such medical treatment, including transportation, and that the Released Parties assume no responsibility or liability for any medical care or decisions.
5. Compliance with Rules and Law
I agree to abide by all event rules, safety instructions, and lawful orders from event staff or public authorities. I understand that participation in a public or unsanctioned event may carry additional legal or regulatory risks, including interaction with law enforcement or local regulations. I accept full responsibility for any consequences arising from failure to comply.
6. Photography and Media Release
I understand that photographs, video recordings, or other media may be taken during the event. I hereby grant 10AMHI.COM and the Event Organizers a perpetual, worldwide, royalty-free license to use my name, likeness, voice, or image for any lawful purpose, including but not limited to marketing, advertising, and promotional materials, without compensation or additional consent.
7. Severability
If any provision of this Agreement is held to be unlawful, void, or unenforceable for any reason, then that provision shall be deemed severable from this Agreement and shall not affect the validity or enforceability of the remaining provisions.
8. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law rules. I agree that any legal action or proceeding arising under or related to this Agreement shall be brought exclusively in the courts located in Delaware. By clicking “Join,” I affirm that I have read, fully understand, and agree to this General Waiver of Liability, Assumption of Risk, and Indemnity Agreement. I acknowledge that this waiver applies to all events, regardless of date, and that I am voluntarily giving up substantial legal rights by agreeing to these terms.
